The problem is that the rich are too highly taxed, so much so that they will go through whatever legal loopholes in the law to avoid paying taxes as much as possible.

It is more beneficially to lower taxes for the rich (and everyone) to the point where they are incentivized to pay taxes rather than avoid them. The government won't get as much money that way but it's better than the rich not paying taxes at all.
