Yes because it is fundamentally unethically to essentially punish people for their mental health issues that drove them to use in the first place. However, they should not be allowed to use them in certain public areas, but the consequence should not be too severe. What would be more helpful to the people is a better mental health care program, which would allow people to free themselves from their devastating addictions. It is also proven that this decreases drug use.
