No, however if the dealers and manufacturers had not done enough background checks and the proper research beforehand that couldve prevented the weapons from getting in the hands of wrong people in the first place, then they should be sued.

Yes, but only dealers because they are selling guns illegally, and putting fire arms in peoples hands that shouldn´t have a fire arm. A fire arm shouldn´t be easy to get.
