There are speech acts which, in a scenario where hate speech is restricted, do not seem to fit neatly into either the "hateful" or "free" categories. Decisions on what to do about them has historically come down to the caprices of the censors. Given that nobody has ever been able to come up with a framework in which this problem does not arise, the act of censoring hate speech necessarily restricts speech that is ambiguous, and so creates a problem separate from the one it is trying to solve.
